Nature protection: European Commission takes legal action against Hungary among other 10 Member States over protected bird areas
The European Commission is taking legal action against 11 Member States for not designating sufficient Special Protected Areas for migratory and vulnerable wild bird species. This violates the EU's directive on the conservation of wild birds. The Commission is sending first written warnings to Hungary and eight other Member States


The cases against Hungary concern a failure to designate a sufficient number of IBAs as SPAs or for designating them only partially.
The European Comission is established an international ecological network, Natura 2000 for saving the natural heritage of the biodiversity. Member States are obliged to designate all of the most suitable sites as Special Protection Areas (SPAs) to conserve wild bird species. The designation of SPAs must be based on objective, verifiable scientific criteria. To assess whether Member States have complied with their obligation to classify SPAs, the Commission uses the best available ornithological information. Where the necessary scientific information provided by Member States is lacking, national inventories of Important Bird Areas (IBA) compiled by the non-governmental organisation (NGO) Birdlife International, are used. While not legally binding, the IBA inventory is based on internationally-recognised scientific criteria. The Court of Justice has already acknowledged its scientific value, and in cases where no equivalent scientific evidence is available, the IBA inventory is a valid basis of reference in assessing whether Member States have classified a sufficient number and size of territories as SPAs.
In Hungary the IBA inventory was compiled by BirdLife Hungary/ MME the hungarian partner of BirdLife International. Approximately 79% of the hungarian IBA-sites is designated for Natura 2000 ecological network. In this respect our country makes a significant proportion in community interested sites of the European Union. However some important bird areas had failed to be designated from this inventory which are not under any national protection – has come to reveal by the analysis of BirdLife Hungary/ MME.
There is significant shortcomings in the existed designation of Jászság, Mátra, Gerecse, Hevesi-sík and Hortobágy sites. According to the IBA inventory more than 160.000 hectares should be designated for Natura 2000 network as Special Protection Area in order to conserve wild migrant and breeding bird species.
The half area of the corresponding Jászság IBA site has been out of the designation despite this site is one of the most important breeding and gathering place of the worldwide endangered Red-footed Falcon, furthermore other globally endangered species such as Imperial Eagle, Saker and Roller is also breeding in the area – notified the executive director of BirdLife International/ MME, Gergõ Halmos. The review of the earlier designation of Jászság site is becoming due because the conservation measure of the hungarian populations of Red-footed Falcon and Saker is supported by the European Unio LIFE Fund.
